Terms of Service

1. Acceptance of these terms
By accessing, signing up for, testing or using EncoreCRM in any way, you agree to these Terms of Service. If you do not agree, please do not use the platform.
2. Programme status and platform changes
EncoreCRM is under active development. Product capabilities may be added, refined, reshaped, temporarily unavailable, delayed or subject to change without notice. Screens, wording and specific features may evolve as the DJ/MC toolset grows.
3. What EncoreCRM provides
EncoreCRM is a software-as-a-service platform that helps DJs, MCs and event professionals manage bookings, clients, events, quotes, planning and related workflows.
4. User accounts
You are responsible for the accuracy of your account information, for keeping your login credentials confidential, and for all activity carried out under your account. Notify us promptly if you suspect any unauthorised use.
5. Workspaces
Each DJ or MC business may receive a private workspace. You may only access workspaces you are authorised to use, and you must respect the access boundaries set by workspace owners.
6. No professional advice
EncoreCRM does not provide legal, tax, accounting, financial, business, music-licensing or compliance advice. Information shown in the platform is for operational convenience and should not be relied on as professional advice.
7. Your responsibilities as a DJ or MC
You remain solely responsible for:
- your client agreements and quotes
- your pricing and payment collection
- your service delivery and event performance
- music licensing, including SAMRO, SAMPRA and any other applicable rights obligations
- communication with your clients and venues
- your tax, accounting and bookkeeping obligations
- compliance with all laws applicable to your business
8. EncoreCRM is not a party to your event contracts
EncoreCRM provides tools — it is not a party to any agreement, booking or dispute between you and your clients, venues, suppliers or guests.
9. Acceptable use
You agree not to abuse, hack, scrape, spam, upload unlawful content, infringe rights, bypass security, share accounts improperly or otherwise misuse the platform. Full details are set out in our Acceptable Use Policy.
10. Subscriptions and payment
Once paid plans are introduced, pricing may be billed monthly or on another stated cycle, and payment may be accepted by EFT, card, debit order or other approved methods. Access may be suspended for non-payment. Cancellation terms will be displayed clearly before the public paid launch. No long-term contract applies unless specifically agreed in writing.
11. Refunds and cancellations
Early access terms may differ from paid subscriptions. Where you are a paid subscriber, you may cancel in line with the stated subscription terms. Refunds may depend on the phase of the product or service, your usage, the payment method and applicable law. Nothing in these terms removes any right you may have under South African consumer protection law.
12. Overdue payments and grace period
You are responsible for paying subscription fees when they fall due. If a payment fails or is overdue, EncoreCRM may mark the account or workspace as overdue and may, at its discretion, provide a reasonable grace period before restricting access. EncoreCRM is not obliged to continue providing full access indefinitely without payment.
13. Restricted access
If payment remains overdue after any grace period, EncoreCRM may place the workspace into a restricted or read-only mode. During restricted access, you may still be able to:
- log in to your account
- view certain account or billing information
- view limited workspace information
- export or request access to your data, where available and lawful
- update payment details, where billing is enabled
While restricted, the following may be disabled:
- adding new clients
- adding new events or bookings
- creating, editing or sending quotes
- automations and reminders
- premium features
- client portal features
- inviting additional users
14. Suspension for non-payment
If payment remains outstanding, EncoreCRM may suspend the workspace or account. This is in addition to any other right to suspend or terminate access for breach of these terms.
15. Data retention after non-payment, cancellation or suspension
EncoreCRM will not ordinarily delete workspace data immediately after non-payment, cancellation or suspension. Workspace data may be retained for a limited period, such as up to 90 days, to allow:
- reactivation of the account
- data access or export, where available
- billing reconciliation
- dispute handling
- legal and regulatory compliance
- security and fraud prevention
- backup management
- audit purposes
After the applicable retention period, EncoreCRM may delete, de-identify or anonymise workspace data, unless retention is required or permitted by law. EncoreCRM may retain limited records where reasonably necessary for accounting, tax, legal compliance, fraud prevention, security logs, dispute resolution or enforcement of these terms.
16. Reactivation
If an account is reactivated during the retention period, access may be restored once outstanding payment or account issues have been resolved. Reactivation after the retention period may not be possible, or may require setting up a new workspace.
17. No liability for restricted access caused by non-payment
To the extent allowed by law, EncoreCRM is not liable for any loss, missed bookings, client disputes or other harm arising from restricted access, suspension, cancellation or deletion that results from non-payment or breach of these terms.
18. Availability and changes
EncoreCRM may improve, modify, suspend, remove or delay features at any time as the platform evolves. We will use reasonable efforts to keep the platform available, but availability is not guaranteed.
19. Data storage and backups
We take reasonable steps to protect data stored in the platform, but you should keep your own copies of any records that are critical to your business.
20. Limitation of liability
To the fullest extent permitted by law, EncoreCRM is not liable for indirect or consequential losses, lost profits, missed bookings, event failures, client disputes, third-party service failures, unsupported devices, internet outages or business interruption arising from use of the platform.
21. Third-party services
Future integrations may include providers such as Google Calendar, payment gateways, WhatsApp, email services and music platforms. EncoreCRM is not responsible for outages, terms or failures of those third-party services.
22. Suspension or termination for breach
We may suspend or terminate access for breach of these terms, non-payment, abuse, security risks, illegal use, harmful conduct or suspected misuse.
23. Intellectual property
EncoreCRM owns or licenses the platform, software, UI/UX, design system, workflows, templates, forms, automation logic, documentation, copywriting, training material, brand assets and all related materials. See our Copyright & IP Notice for more detail.
24. No copying, cloning or competing misuse
You may not copy, reproduce, resell, redistribute, reverse-engineer, scrape, export, clone, imitate, commercially exploit or otherwise use EncoreCRM systems, templates, workflows, documents, forms, layouts, prompts, automations or training material outside the platform.
25. Your content
You own your client and event data and any content you upload. EncoreCRM processes that content only to provide, maintain, secure and improve the service, in line with our Privacy Policy.
26. Client data you enter
When you enter your clients' personal information into EncoreCRM, you confirm that you have a lawful basis to do so and that you will handle that information in line with applicable privacy laws.
27. Marketing use
EncoreCRM will not publicly use your name, logo or testimonial without appropriate permission.
28. Support
Support is provided through approved support channels and during reasonable support hours. We do not offer 24/7 support unless specifically agreed in writing.
29. Governing law
These terms are governed by the laws of the Republic of South Africa.
